Introduction

The following Terms and Conditions govern user interaction with Think Travel (both on- and off-line). This includes any interactions with Think Travel agents, employees, or management, bookings made through Think Travel agents or through its websites, and the use of the thinktravel.ca website and the online.thinktravel.ca website. By accessing Think Travel’s websites and/or interacting with Think Travel agents, employees, or management You agree to be bound by these Terms and Conditions.  Think Travel reserves the right to amend these Terms and Conditions at any time. Should the Terms and Conditions be amended, all changes will take effect immediately once they are updated. Your continued use of Our Websites and/or continued interaction with Think Travel agents, employees, or management after Terms and Conditions have been updated will mean that You accept those changes.

Definitions

"Think Travel", “We”, “Us”, and “Our” all refer to Our physical offices, agents, thinktravel.ca, and online.thinktravel.ca

"Our Websites"refers to both thinktravel.ca and online.thinktravel.ca

"Site"refers to thinktravel.ca

"Member Portal” and “Portal"refer to online.thinktravel.ca

"Service” (collectively, “Services”) "refers to all flights, hotels, attractions, car rental, cruise, and insurance services offered on Our Websites

"Service Provider” (collectively, “Service Providers”) "refers to third parties, such as airlines, hotels, insurers, car rental companies, and cruise companies who render Services as defined above

"Booking” (past tense, “Booked”; present and future tense, “Book”) refers to making any booking or reservation for any Service through online.thinktravel.ca or through a Think Travel agent

"You”, “Your”, and “Yourself"all refer to any person who is using Our Websites or Booking through Us

"Member” (collectively, “Members”)"refers to an individual who has registered as a member on Our Member Portal

"Content"refers to all content on Our sites or available in-person through Our agents, employees, and/or management, including (but not limited to): itineraries, tickets, reservation information, and Booking confirmations

Acceptable Use of Our Websites

By using Our Websites, You agree that You may only use the information provided for personal and non-commercial use. This means that You are not permitted to copy, reproduce, modify, download, or distribute any of Our Content or software, with the exception of making copies of itineraries, tickets, and/or Booking confirmations for Your personal use. You are also not permitted to deep-link, monitor (e.g. spider scrape), display, transfer, publish, license, or create derivative works from any of Our Content or software for any commercial or competitive purposes except with explicit prior permission from Think Travel.

The Intermediary Role of Think Travel

The role of Think Travel is strictly and exclusively that of an intermediary. We do not offer any products or services of Our own. The role and obligations of Think Travel is limited to relaying Your Booking information to the relevant Service Provider(s) for the Service(s) You have Booked and sending You a confirmation email for Your Booking on behalf of the Service Provider(s). In Booking with Think Travel, You authorize Us to operate as an intermediary between Yourself and the relevant Service Provider(s), including mediating payment for Service(s) You have Booked.

By Booking, You enter into a direct (legally binding) contractual relationship with the Service Provider of the Service for which You have made a Booking. You therefore agree to be bound by the Terms and Conditions of the Service Provider. By Booking with Us, You agree that it is solely Your responsibility to check the Terms and Conditions applicable to the Service for which You are Booking, and that it is Your responsibility to check the Terms and Conditions of the Service Provider. Think Travel is not responsible for any Terms and Conditions set by a Service Provider, and You agree to release Us from any liability or responsibility resulting from Your failure to comply to the Terms and Conditions which apply to any Service. By Booking any Service, You acknowledge that You understand that any violation of any of the Service Provider’s rules and restrictions may result in the cancellation of Your Booking, in Your being denied access to the Service, in Your forfeiting any monies paid for the Booking, and/or in Our debiting Your account for any costs We incur as a result of such violation.

You further agree that Think Travel is not responsible, in any capacity, for any bookings, reservations, or purchases which are not made through Us. If You choose to purchase such additional services or goods as part of Your trip, You are solely responsible for the Terms and Conditions governing the use or purchase of such services and goods.

Please note that, for Your convenience, Our Website includes links to other websites. If You decide to access these websites, You do so at Your own risk. Our inclusion of any link does not constitute an endorsement of its contents, nor are We responsible for the contents of other websites.

Accuracy of Information

The information that We provide is based on information provided to Us by Service Providers. It is the responsibility of the Service Provider to provide accurate and updated information regarding their Service (including, but not limited to, availability, pricing, and policies of the Service). Although We strive to provide You with accurate information about all Our Services, Think Travel claims no responsibility for any inaccurate information provided by a Service Provider and disclosed by us. We do not guarantee that the information on Our site is accurate, complete, or true, and cannot be held responsible for any errors, inaccurate, misleading, or untrue information, or missing information. You are encouraged to contact the Service Provider directly to verify the information regarding Your selected Service prior to Booking.

Please note that, as Think Travel operates strictly in the capacity of an intermediary, We are not responsible for the quality of any Service Booked through Us. While Our agents will work with You to help You make the most appropriate Booking for Your needs, We make no representations or warranties as to the quality of any given Service. It is the Service Provider’s responsibility to provide a quality Service. Please direct any comments, questions, or complaints about the quality and performance or non-performance of any Service to the relevant Service Provider.

Conditions for Booking

By Booking with Us, You certify that You possess the legal authority to enter into a binding legal agreement, including having reached the age of majority in Your province of residence. You further certify that You will only make Bookings on behalf of Yourself or on behalf of those for whom You are legally authorized to act (such as Your spouse or children), that You agree to be financially responsible for all of Your use of Our Websites (including the use of a Member account by others), and that You will inform all those on whose behalf You have made a Booking of the Terms and Conditions which apply to the Booking (including Our Terms and Conditions and the Terms and Conditions of the relevant Service Provider). Think Travel is not responsible for any problems or costs which may arise as a result of any person, for whom You made a Booking, not complying with or being aware of the applicable Terms and Conditions.

You further agree to provide complete, correct, accurate, and true information at the time of Booking. You agree not to make any speculative, false, and/or fraudulent Booking. Think Travel reserves the right to cancel any Booking or Member account if it shows signs of suspicious or fraudulent activity, and to take legal action if necessary.

General Guidelines for Airline Bookings

Please note that the flight times shown in Your Booking confirmation may change between the date of Your Booking and the date You actually travel. Flight times are determined by airline Service Providers, and Think Travel accepts no responsibility for any changes or cancellations of a flight or for any costs associated with a change or cancellation. It is Your responsibility to remain up-to-date on the status of Your flight. We recommend that You contact the Service Provider with whom You have Booked a flight at least 72 hours before the scheduled departure of the flight to ensure that the flight (and any connecting flights) will depart on schedule. Airlines also often have special requirements for who can, and cannot, book onto a flight, and what accommodations will be provided. It is Your responsibility to ensure that You adhere to the Terms and Conditions set out by the Service Provider with whom You have Booked. It is also Your responsibility to check for any restrictions to Your ability to travel which the airline may have set out. Think Travel does not verify if You are eligible to travel and is not responsible if You are denied boarding onto Your flight. You are encouraged to contact airline Service Providers directly if You have any questions. In particular, keep in mind the following guidelines for travelling while pregnant or with young children and regarding unaccompanied minors:

i. Pregnancy: If You or a Member of Your travel party is pregnant, please check with the airline Service Provider for Your flight to confirm that You will be able to fly. In particular, please note that some airlines refuse to transport individuals who are past the 28th week of pregnancy on their aircraft.

ii. Travelling with Young children: If You are travelling with young children, please check the policies for travelling with young children for the airline Service Provider with whom You have Booked Your flight. Most airline Service Providers require that children above two years of age have their own seat and are Booked as child tickets, while children under the age of two travel as infants and are not provided a separate seat. You are encouraged to contact the Service Provider directly to obtain the conditions for traveling with a child who will not have a separate seat. Please note that if a child reaches the age of two before the end of the trip, a child ticket must be Booked for the entire trip. Furthermore, please note that infant tickets cannot be Booked before birth, as the name and date of birth on the ticket must match the information on the passport.

iii. Unaccompanied Minors: Think Travel does not allow Bookings for unaccompanied minors through Our Portal. If You would like to book a ticket for an unaccompanied minor, please contact the airline Service Provider directly.

Baggage Policies

Baggage allowances and fees for excess baggage are not the responsibility of Think Travel. It is Your responsibility to check in advance regarding baggage allowances and fees with the airline Service Provider for any flight for which You have made a Booking. All fees are directly payable to the airline Service Provider with whom You have Booked. Furthermore, Think Travel accepts no liability for lost or damaged baggage. If You require any assistance with baggage policies, or wish to report lost or damaged baggage, please contact the Service Provider directly.

Please note that if You have a connecting flight, You may need to reclaim Your bags at the connecting airport, and then check the bags in again to continue Your journey. Please be advised that if You have excess baggage for a connecting flight, You will be required to pay excess baggage fees assessed by all airline Service Providers with whom You have Booked. Think Travel accepts no liability if You are asked to pay additional fees due to excess baggage.

One-way tickets

Where the option is made available by the Service Provider, Think Travel offers You the option to book two one-way tickets instead of a roundtrip ticket for Your flights. Customers should be aware, however, that each one-way ticket is subject to its own rules, restrictions, and fees. By choosing to Book two one-way tickets, You agree to be bound by the Terms and Conditions laid out by the Service Providers for each individual ticket. Furthermore, You acknowledge that You are aware of the risk that, should one of the flights You have Booked be affected by a change or cancellation, it may cause You to have to make a change to the other flight. Moreover, should one flight be changed or cancelled and cause You to make changes to the other flight as a result, it will be Your responsibility to pay the exchange fees for the unaffected flight, as determined by the relevant Service Provider. You agree to absolve Think Travel of any and all liability if such an event occurs.

Special Requests and Accommodations

Think Travel is not responsible for handling any special requests (including, but not limited to, meal preference, seat preference, or cruise line dining times) or requests for any accommodations (including, but not limited to, special meals, child seats, or wheelchair accessible rooms). All such requests are handled by the Service Provider.

If You have any special requests or require any accommodations, please check with the Service Provider in advance to be certain they will be able to accommodate Your request, ideally prior to making a Booking with us. Please note that, in Our intermediary capacity, Think Travel bears no responsibility should a Service Provider be unable or unwilling to accommodate You, or if Your requested preference or accommodation is not made available to You during Your Trip.

Some Bookings through Our Member Portal may include an option for certain requests and accommodations. However, Think Travel makes no guarantees that such an option will be available when making an online Booking, or that Your desired or necessary request or accommodation will be listed among the available options. Furthermore, should the option be available, and should You request any of the options provided to You when booking, while Think Travel will communicate this information to the Service Provider, We make no guarantees that the Service Provider will be able or willing to fulfill Your request. It is Your responsibility to check with the Service Provider to ensure Your request was received and will be available.

Service Fees

Please note that Our service fees are non-refundable and are subject to change without notice. In addition to the fees listed below, You may also be subject to government-imposed taxes and fees, if changes are permitted by the Service Provider.

Payment Policy

For online Bookings, a reservation will not be processed until and unless payment is paid in full. Similarly, for Bookings through Our agents, full and final payment must be received at the time of Booking. Unless You have paid in full, Your reservation is not finalized and We reserve the right to cancel it at Our discretion unless payment is received. By Booking with Us, You authorize Us to use Your card number or cash payment to pay for Your selected Travel Service, and indicate Your acceptance of Our Terms and Conditions. Please note that on Your credit card statement, Think Travel will appear as “Think Travel Limited.”

Please note that some hotels require that You provide Your credit card information or a cash deposit when checking-in to cover any additional expenses which You may incur during Your stay. Any such deposits or charges to Your credit card are in addition to payment received by Think Travel for the Booking itself, and are paid directly to the Service Provider. Such payments are the responsibility of the hotel Service Provider, and are not associated with Think Travel in any way.

Think Travel accepts all major credit cards (including MasterCard, Visa, and American Express cards). For in-person Bookings through Our agents, We also accept cash payments and debit cards. Please note that We only accept payments in Canadian Dollars. If Your credit or bank card is in a different currency, please note that Your credit card company or bank will apply an exchange rate and may also charge a service fee. Think Travel is not responsible for any additional costs which You may incur as a result of using a credit or bank card in a different currency. Cash payments in foreign currency will not be accepted

After You submit Your payment information to Us, We confirm its accuracy and the validity of Your card with the credit/debit card company. Please note that fares are subject to change until We have verified Your payment information. Think Travel is not responsible should Your card be declined for any reason (including, but not limited to, inability to verify Your information), nor are We responsible for any changes in the fare or for any other charges during the verification process.

Confirmation of Booking

Once You have submitted Your details to Us, whether through the Member Portal or through one of Our agents, We will process Your request and send You a confirmation email with Your Booking information. If Your Booking request is submitted during Our business hours, You can expect to receive a confirmation from Us within four hours of submitting Your details. If Your Booking is request is submitted outside these business hours, You can expect to receive a confirmation by 2pm the next business day. If You have not received an initial confirmation email stating that We have received Your information within these time frames, please contact Us at online@thinktravel.ca. Similarly, if You notice any errors or discrepancy in Your confirmation email, please contact Us immediately.

Please note that all prices and Bookings are tentative until Your ticket has been issued. We will notify You if the price for a Service changes after Booking, at which point You will be given the opportunity to either cancel the Booking (at no cost and with a full refund) or accept it at the new price. Once Your payment has been processed, You will be sent a confirmation email which includes either Your e-ticket or a Booking confirmation number for the Service You have Booked. Please note that Your Booking is not confirmed until You have received a confirmation email from Us which includes ticketing information or a booking confirmation number. Please note that with some itineraries, an e-ticket option is not available. In such cases a paper ticket will be issued. Please note that if a paper ticket is issued, it will be Your responsibility to pay the shipping charges. You are encouraged to check shipping charges for a paper ticket prior to Booking.

Refund Policy

All Our service fees (outlined in the “Service Fees” section of these Terms and Conditions) are non-refundable. If You wish to cancel a Booking, refunds requests are subject to the Terms and Conditions of the Service Provider with whom You have Booked. Some Service Providers do not allow for cancellation, or only allow credit options for a cancellation. You are advised to check cancellation and exchange policies for the relevant Service Provider prior to Booking with Us. In particular, please note that not all tickets are able to be cancelled or exchanged and that all airline tickets are fully non-refundable.

Please be advised that if a cancellation or exchange option is permitted by the relevant Service Provider, it may carry a penalty charge payable directly to the Service Provider. In addition, if You choose to cancel or exchange through Think Travel, this will carry an additional service fee (explained in Our “Service Fees” policy above).

Changes and Cancellations by a Service Provider

Where possible, if We are informed of a change or cancellation of a booking, We will notify You, and We will endeavour to help You should such a change or cancellation occur. However, it is Your responsibility to be aware of the applicable Terms and Conditions of the Service Provider, which may include information about cancellation or amendment of a booking. In Our capacity as an intermediary, Think Travel accepts no responsibility for any changes or cancellations by a Service Provider after a booking has been arranged.

Responsibility for Travel, Identity, and Reservation Documentation

While Our agents will endeavour to help You prepare for Your journey, it is Your responsibility to ensure that You meet the entry requirements for travel to Your destination (including any foreign entry requirements) and that You carry the necessary travel documentation (such as passports and visas) for Your trip. Similarly, for any hotel reservations, car rentals, or attraction bookings, it is Your responsibility to carry the necessary identification and reservation documents (such as drivers licences, itineraries, tickets, and the credit card You used at the time of booking) as required by the Service Provider.

Furthermore, it is Your responsibility to ensure that all such travel and identification documentation is current and accurate. At times, the travel or identification documentation requirements for a given destination may change between the time of booking and the date of the trip. You should check for up-to-date information prior to departure.

We accept no liability should You be refused boarding on a flight or entry into any country due to Your failure to carry correct, valid, and adequate travel documentation as required by the Service Provider and any authority or country as relevant, including countries You may just be transiting through. Similarly, We accept no liability if You are unable to access a hotel reservation, car rental, or attraction due to a failure to carry correct and adequate identification or reservation documentation.

Considerations for International Travel

It is Your responsibility to be aware of requirements for entry or transit through international destinations (including but not limited to passport and visa requirements, health requirements such as vaccinations, and documentation requirements such as birth certificates) as well as any travel warnings, prohibitions, announcements, or advisories issued by Your government and the relevant governments of Your destination prior to Booking. Please note that requirements may differ based on Your nationality, and that it is Your responsibility to be aware of which requirements, warnings, prohibitions, announcements, and advisories are relevant to You, as well as timelines associated with obtaining any requirements (such as visas or vaccinations). Passports should be valid and undamaged. If Your passport is damaged in any way, You may be denied boarding or entry into Your destination. Please note that some countries require that Your passport be valid for up to six months after the completion of Your travel.

We are not responsible for any issues or incidents that arise from a failure to comply to official regulations, or due to a lack of awareness about a warning, prohibition, announcement, or advisory associated with a destination. We also recommend that You familiarize Yourself with the laws and customs of Your destination prior to Booking, as the language, living standards (including provision of utilities, services, and accommodation), and/or practices of Your destination may differ from those found in Canada. Canadian citizens are advised to contact Foreign Affairs Canada at http://www.travel.gc.ca for assistance.

Furthermore, please note that Customs and/or immigration officials may, at their own discretion, deny any individual, whether they are residents or visitors, entry or re-entry into their country. Think Travel is not responsible for denied entry under any circumstances.

Act of God/Force Majeure

Think Travel assumes no liability for any loss, damage, or injury of any nature resulting, in whole or in part, from an Act of God or any other Force Majeure condition including, but not limited to: fire, volcanic eruption, environmental pollution or contamination, inclement weather, earthquake, flood, water or power shortages or failures, tropical storms or hurricanes, riots or civil commotions (or disturbances and any other acts of similar nature), sabotage, arrests, strikes or other labour disruptions, restraints of rulers or peoples, expropriations, acts of terrorism, war, insurrection, quarantine restrictions, government health advisories or warnings or alerts of any kind or nature, government seizures, or any other unforeseen circumstances in the place of departure or destination or any other unforeseen factor which negatively impacts or hampers Our ability to fulfill any of Our contractual conditions. In the event that any of these conditions apply, Think Travel shall be released from liability of any kind.

Membership and Rewards Program

Think Travel is pleased to offer a Member Portal through which You can find Services and make Your own Bookings. The Member Portal requires an initial registration, which is reviewed by a member of Our Think Travel team. If approved as a Member, You will be granted access to Our Member Portal. Members agree that it is their responsibility to safeguard their information and for any use of their account, whether by You or someone else. We reserve the right to deny or revoke Membership at Our sole discretion, at any time and for any reason, including, but not limited to, for violation of these Terms and Conditions.

Users who sign up as Think Travel Members are automatically enrolled in Our rewards program. Members may ask to unsubscribe from emails about the rewards program, or to be removed from the rewards program entirely, by emailing rewards@thinktravel.ca. Members who remain in the rewards program agree to be bound by the terms and conditions of the program and, where specified, terms and conditions specific to the redemption of the reward, such as regarding transferability or ability to combine rewards with other Members. Rewards may only be redeemed by contacting rewards@thinktravel.ca.

Promotions

From time to time, Think Travel may run promotions on Our Websites, which may be available to all users, may be exclusive to Members, or may be restricted (such as being available only to those in a certain location or through certain Service Providers). Such promotions will have both a start date and an end date, with the terms of the promotion being in effect only in the time between the start and end dates. Such promotions, unless otherwise specified, may not be combined with any other promotions or rewards which are available at the same time. Think Travel further reserves the right to withdraw a promotion at any time, with or without prior notice.

Insurance Policy and Disclaimer

Insurance plans for Think Travel Services are provided by Manulife. In choosing to purchase insurance, You are agreeing to be bound by Manulife’s Terms and Conditions, and agree to release Think Travel from any liability, financial or otherwise, with regards to Your insurance purchase.

Indemnification and Release

By using Our Websites and/or Booking with Us, You agree to protect and indemnify Think Travel from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties, or other costs or expenses of any kind or nature (including, but not limited to, reasonable legal and accounting fees) brought by:

a. You or on Your behalf in excess of the liability described above; or

b. by third parties as a result of:

  • Your breach of these Terms and Conditions, notices or documents referenced on Our Websites;
  • Your violation of any law or the rights of a third party; or
  • Your use of Our Websites

Furthermore, should You have a dispute with a Service Provider, You release Us from all claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes.

Jurisdiction

Our Websites are operated and controlled in Canada. This agreement shall be governed by and is construed in accordance with the laws of the Province where Your selected Think Travel agency is located (or, if no such agency is selected, the laws of the Province of Alberta), without giving effect to any principles of conflicts of law. If any provision of this agreement is found to be unlawful, void, invalid, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.

Copyright and Trademarks

Think Travel is a registered trademark. All rights reserved. All information and artwork on Our Websites are protected by copyright. All pictures on Our Website are either owned by Think Travel or used with permission. Think Travel retains full and complete title to all downloadable software and all images incorporated or generated by the software. Unless otherwise specified, all trademarks used on Our Website are the property of Think Travel or another party and in the latter case are licensed to Think Travel for use in association with its operations.
